Resignation to escape
disciplinary proceedings ineffectual
Application for review
by former directors of underwriting group,of Lloyd's Committee's decision to
continue disciplinary proceedings against them notwithstanding their
resignations from Lloyd's, refused.
HELD: Each applicant had
undertaken on becoming a member that he would not resign "without giving
to the Committee such notice of his intention as may be required by
them.." The Committee, which had been set up under the Lloyd's Act 1982,
had a discretion to refuse an immediate resignation which was what it did.
Applicants therefore were still members & it was unnecessary to consider
whether the disciplinary proceedings could continue if they were not.
